| SWEDEN: New precedent from the Swedish Supreme Court regarding notice of termination in distribution contracts. According to a Supreme Court Case from late 2009(1), a notice period of three months was considered reasonable. The contract (based on an oral agreement) was made for an indefinite term, containing no provisions regarding period of notice. The distributor acted as a sole distributor within the territory, however entitled to sell other (competing) products. The supplier terminated the contract with immediate effect after seven years of cooperation. [more] | ||
| SPAIN: Modification of the Spanish Commercial Retail Act affecting distribution and franchising activities. The Act 1/2010 of 1st March (Official Journal of March 2, 2010) has modified the Spanish Retail Act (7/1996) of January 15th. The purpose of this modification is to adapt the national legislation to the new legislation in the European Union particularly the Directive 2006/123/CE of the European Parliament and the Council in order to simplify the administrative processes and procedures and to suppress the unnecessary barriers for the obtainment of the pertinent administrative permissions for commercial activities.
